Requirements and Eligibility for E Visas

According to the U.S. State Department the requirements for the E visa are as follows:

E-1 Visa: Treaty Traders

  • The worker must be a national of a country with a commercial treaty with the United States.
  • The worker wishes to enter the U.S. to conduct substantial trade between the treaty country and the U.S.
  • The worker will be employed as an executive or manager, or has highly specialized skills that are essential to the trading.

E-2 Visa: Treaty Investors

  • The investor must be a national of a country with a commercial treaty with the United States.
  • The investor must have made a substantial investment in operations in the U.S.
  • The person must be the principle investor, and if not, he or she must be employer as an executive, manager or employee with highly specialized skills.

E-3 Visa: Australian Workers

  • The employee must be a national of Australia.
  • The work must be temporary in nature and involve specialty employment that requires specialized knowledge and a bachelor's degree or higher.

Each of these E visas requires a specific visa application and other requirements. For example, an E visa holder cannot apply for a permanent resident card while holding E-visa status.
