Family Based Immigration

United States citizens and legal permanent residents of the United States are able to petition for family members to become legal permanent residents. Only a specific number of family visas are available each year. Therefore, family visas are given based on family relationship preference. Family based (F) preferences include:

  • First preference (F-1): First preference family based visas are available to immediate family members of U.S. citizens. First preference family visas are the quickest visas available because you do not need to wait for a visa number. Immediate family members include spouse, parents of an adult child, and unmarried children under 21 years old.
  • Second preference (F-2): Second preference family based visas are available to family members of legal permanent residents. These family members include (F-2A) spouses and (F-2B) unmarried children under 21 years of age.
  • Third Preference (F-3): Third preference family based visas are available to married children of U.S citizens.
  • Fourth preference (F-4): Fourth preference family based visas are available to siblings of U.S. citizens that are over 21 years of age.
